These Terms of Service (“Terms”) are a binding agreement between you and Living Palate (“Living Palate”, “we”, “us”, or “our”) and govern your access to and use of the Living Palate web application and related services available at palate‑app.pages.dev (the “Service”). Please read them carefully.
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service relates to wine and other alcoholic beverages. You must be of legal drinking age in your jurisdiction — and in any case at least 18 years old — to create an account or use the Service. By using the Service, you represent and warrant that you meet these requirements and are able to form a binding contract with us.
Living Palate is a personal wine‑tasting journal, cellar tracker, and AI‑assisted palate tool. It lets you record wines, rate them, organise a cellar, and receive AI‑generated predictions, flavour profiles, scans, and recommendations. We may add, change, or remove features at any time.
You need an account to use most of the Service. You agree to provide accurate information, to keep your password confidential, and to be responsible for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised. We may require approval for, or otherwise limit, registration at our discretion.
You retain ownership of the content you submit to the Service, including wine entries, notes, ratings, and photographs (“Your Content”). You grant us a worldwide, non‑exclusive, royalty‑free licence to host, store, reproduce, process, and display Your Content solely to operate and provide the Service to you — including transmitting relevant content to our AI provider to generate features, as described in our Privacy Policy.
You are responsible for Your Content and represent that you have the necessary rights to it, including any photographs you upload, and that it does not infringe the rights of others or violate any law.
The Service uses artificial intelligence to generate predictions, flavour profiles, tasting notes, wine “facts,” scan results, and recommendations. This output is generated automatically, may be inaccurate, incomplete, or out of date, and is provided for personal, informational purposes only. It is not professional, purchasing, financial, medical, or dietary advice. You should independently verify anything important — such as a wine’s identity, vintage, price, or availability — before relying on it. Recommendations are not an offer to sell, and we do not guarantee that any recommended wine exists or is available.
Living Palate is intended to support the responsible, lawful enjoyment of wine. Nothing in the Service is medical or nutritional advice. Please drink responsibly and comply with all laws applicable to you, including those concerning the purchase and consumption of alcohol.

The Service, including its software, design, and the “Living Palate” name and branding, is owned by us or our licensors and is protected by intellectual‑property laws. Subject to these Terms, we grant you a limited, personal, non‑exclusive, non‑transferable, revocable licence to use the Service for your own personal, non‑commercial use. We reserve all rights not expressly granted.
The Service relies on third‑party providers, including Cloudflare and Anthropic. Your use of the Service may also be subject to those providers’ terms, and we are not responsible for third‑party services or content.
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free, or that any AI‑generated output or wine information will be accurate or reliable.
To the maximum extent permitted by law, Living Palate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or US$50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Living Palate from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
We may modify these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict‑of‑laws rules. You agree that the courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law gives you the right to bring proceedings in your local courts.
